Thanks for that. I'd like to go ahead and order the 175mm sills in the amounts needed for the rear and side windows Alex and I discussed in email (I believe you were CC'ed but let me know if you don't have access to that email). Can you prepare the quote?
As discussed, I don't yet have the precise angle for the kitchen bay window and its two fixed panels -- my builder will measure that shortly, please prepare the order for the rest now.
Also, can you please send along any of your technical specifications you require to be followed by our installer for the windows -- Polish is good, English too if you have it.

Michael

Marcin,

These prices seem quite expensive.   Alex had said:
"Tomorrow morning I will draw you quotation for them at trade prices so you will benefit from solid discount taking this alongside current order. Will be delivered hopefully as one order depends on manufactures timing."

It sounds like you've forgotten that discount.

Alex,

Sill dimensions look good except for the following ones that are meant for a kitchen bay window:
4.       FP02,FP03 windows width 505 cill width 515
5.       W6 window width 1365 cill width 1375

I would imagine this bay window will require a single 'trough'-shaped sill:

\__/

I don't know how you do that -- do you fabricate it as such, or send a single, extra long piece of trim that onsite will be cut with 2 notches and bent?  Damian has seen the window so can confirm what would be needed.

In terms of large sliding door, window above it and new tall window (in reception, not kitchen), we may still need to make adjustments. Possibly higher on sliding door. Can I confirm your not going to begin production on those 3 (which we accept can come later) until you've sent the final paperwork for them and I've initialled as we've done for all the other windows?

Alex understands my "concerns and incontinence related to delay"

Dear Micheal,

Adpol Timber&Composite Windows&Doors Ltd doesn’t own any website stating that we (Adpol Timber&Composite Windows&Doors) are FENSA certificated. And again I will remind you that we are not. We don’t provide installations. If we will start providing them we will become members of FENSA.

Polish manufacturer website (not our – we are separate), own by Adpol Poland mentioning that Adpol GB was certified. We are not AdpolGB. We flagged this issue to manufactures that website is not up to date but as this is separate to us, to our business and trading name and we don’t have any enforcement in it.  We can just flag issue. Point here it’s that there is no information that Adpol Timber&Composite Windows&Doors has FENSA certification.

We never stated that D&P WINDOWS SERVICES (UK) LTD (Damian installation company) its FENSA certificated. We mentioned before that his company it’s in process of obtaining certification. As well we informed you before that any installers queries should be taken with your preferred installer who will be caring on job.  We will be happy to assist in it as supplier but it’s up to you (client) to decide who will install your windows and how they will be installed and finished. We are suppliers of windows and our role here is very limited. We provide you with quality product, legal certification regarding to its quality, specification and building regulations, warranty. Services what we don’t provide - we simply don’t provide.

One again let me clarify. FENSA isn’t certification for product like windows or door. It’s for installation only – full stop. You cannot expect us to certify service or product (such installation) when we don’t provide it. That’s the reason why only installers are certified not manufacturers or dealers etc. Our certification as well manufactures certification is freely available information accessible by anyone interested.

Regarding to manufacturing process and delivery time. If something it’s out of our hand its simply is. At the time when our agreement was finally confirmed/signed we estimated delivery time accordingly at the time. Reason why we always estimate delivery time its due to numerous factors involved up to final point when delivery will reach customer. Order its manufactured to order – not of the shelf and we depend very much on external suppliers of glass, wood, aluminium and mechanical components for moving and internal  mechanisms. Addition to it are logistics and delivery - that again you’re very much aware that order its manufactured 2000 miles away. Does factor are out of our control what directly reflects in estimated deliver time. According to our order size and product type we estimate our delivery time based on average time in previous orders.

Doesn’t exist something like ‘concrete delivery date’ – and that simply reason what we cannot provide it for you. We simply never guarantee delivery time due to multiple factors mentioned already above. Such an usual to us concerns should be raised on initial enquiry so we could advice you accordingly before agreement was made. We always doing our best to provide correct  and honest information according to our knowledge. We don’t avoid any answers and responsibilities.

Please understand that we recognize and understand your concerns and incontinence related to delay in your initial windows installation. I know it is inconvenience. We are not aware of progress and extend of works carried out in your property as we don’t manage it. This is out of our management and any control. It’s up to client/main contractor how he will manage situation being aware that delivery times are not bound.

We acknowledged your conditional desire for 28 days delivery time and be sure that we are pulling all available strings to have this completed not only within 28days but simply ASAP.

We are working very hard to complete your order and we will do our best to fulfilled our arrangements. But until order will be fully manufactured we cannot deliver it. Delays caused by external material suppliers are seriously out of our control. We are doing our best to keep you updated with every information what we have answer any query to best of our knowledge. We recognize fact this is huge inconvenience for you (as well for us) and definitely isn’t our intention to start throwing legal term on each other. Our aim is to resolve this (by delivering quality product asap) in right manner accordingly to situation and maintain established friendly relationship based on understanding.

I hope our answer fullfill your doubt in raised factors.

In UK, Consumers Can Add "Time Is Of The Essence"

From: Michael Maguire [mailto:michael.maguire@gmail.com]

Subject: Re: FW: Tried calling this morning -- fixing delivery date

Alex,
In terms of delivery time, you have quoted your Terms & Conditions, specifically section 6.4 which stated "Time for delivery shall not be of the essence unless previously agreed by the company in writing".  It's always unfortunate when a commercial relationship resorts to the fine print.  I'm sad to see it's come to this.

However, you should be aware that in the UK, consumers have rights which supersede any contract terms.  In particular, please see the Sale and Supply of Goods Act which applies in this case.

According to this law, as consumers we have the right to add "time is of the essence" to the contract after you have been guilty of undue delay.

You need to understand that my emails asking for concrete delivery dates over the past few weeks, specifically starting with my email
23 August 2012 20:58 have been quite clearly making time of the essence.
Without prejudice to those emails already being a declaration that time is of the essence, and without prejudice to our rights related to your website's claims of you providing a FENSA-certified installation of your windows, for the avoidance of doubt, let me state now that time is of the essence for this order.
In our case, this is for the following reasons:
- we live in the house requiring your windows and have performed internal demolition to prepare for their arrival.  There are wall treatments we can't finish until the new windows arrive.  As the weather gets colder, this is becoming more of a problem because of draughts
- we have made new holes in walls (aside even from the big windows which we agreed would come later) to make room for new windows -- these holes while covered are not weatherproof and winter approaches
- we have external insulation providers who are waiting for your windows to be installed before they can install and it will be more difficult for the external insulation providers to proceed once the weather turns

- we have erected scaffolding around the house in preparation for the external insulation providers which is rented per week
Under the law, after an undue delay, I have to give you a reasonable time to fill the order, after which we are within our rights to demand a full refund and you are indeed liable for damages, contrary to what you may feel your contract Terms and Conditions state.

Yesterday I said Sep 21st, which was 3 weeks from when you last told us 3 weeks for the windows.  However after taking advice, for the purposes of the Sale and Supply of Goods Act, I'll now state that you have 28 days from 28th August end-date our purchase contract promised for the windows. In other words, you have until Tuesday September 25th 2012 to deliver the windows.

Regards,
Michael
